    Default Uninsured Driver Facing an Injury Lawsuit

    I had the accident 2 years ago, after two years I been blamed from plaintiff insurance for damage and personal injuries. I end up with this with the payment plan, paying $5000, now the plaintiff is suing me for personal injuries for $ 30.000. I don't now how to stop it. I am thinking about the bankruptcy.
    in the police record there is no injuries marked during the accident. She did not show in a traffic court. From my side I have also make some mistakes, left the scene and had no insurance. I don’t know what to do now; some people say I have to hire a good lawyer; other say you will loose and you have to do bankruptcy.

    Hello,

    I'm kinda of in the same situation. I was in an accident last month uninsured and no license. The other person had the right away because "I failed to yield at a stop sign" even though she hit me, and my car is messed up and she didn't have insurance either, she is now trying to sue. I recently got PrePaid Legal for $30 dollars a month because I can't afford a "good attorney" I'm waiting to see what they say and I will let you know if I can help you get some counsel as well.

    Sometimes it is necessary to declare bankruptcy to resolve claims from a personal injury accident, where you don't have insurance.

    With regards to vrhlp, it is not uncommon for a lawyer to name everybody involved in an accident in a lawsuit. When the discovery process is over, then those who clearly are not liable are dropped from the lawsuit. This way nobody who has any liability, particularly those persons that the lawyer is unsure about and those who have no known liability before the discovery process begins is excluded.

    The long delay is not unusual either. The lawyer may simply have waited until all of the plaintiffs injuries are know and future expenses and losses are calculable or reasonably estimatable.

    As to what to do, I would seek a legal consultation.

    I'm a first time home buyer as well, will I loose my house if declare bankruptcy?

    There are homestead exemptions for bankruptcy, so it's unlikely. You can discuss your exemptions with a bankruptcy lawyer in your state.
