    Default Effect of Open Container Misdemeanor on Future Employment

    My question involves criminal law for the state of: New York
    I got a ticket today at 3:03 pm ET for 10-125 sub (b) violation or the "open container" misdemeanor. I realize it is simply a misdemeanor, but the officers graciously only wrote me one ticket (the 10-125 sub b); the issue is that I am 18. Many others have said "It's just like a parking ticket." Do employers look into these matters deeply? Or is it as simple as similarly,a teenager running a stop sign? Would it be advisable to show up to court and dispute the case? However, the only issue with that is since I am 18, the judge may become suspicious that an "Underage Possession of Alcohol" ticket was not written. Any help is greatly appreciated.

    Nope. As the officer noted, it's about as serious as a parking ticket. You can even handle the whole thing by mail.

    Pay the fine and stop fretting. And don't have open containers in public any more, or any containers at all til you're 21. You're less likely to worry your hair out that way.

    Great, thanks very much for the quick response LawResearcherMissy. So, when employers ask "Have you committed a crime?" on application documents, must I reply yes even though it's only a misdemeanor? Or is it more common (that my friend where I'm currently working has told me) that employers ask "Have you even been arrested?" Finally, I would like to clarify the question before this. Do they take the misdemeanor seriously? "Look into the matter deeply" was much too vague and I'm not 100% sure whether the answer is still pertinent. For example, would an employer look down upon this certain misdemeanor, or is it common enough that an employer could easily forget the matter. Thanks for the suggestion to not touch alcohol until I'm 21, abstinence is the best way to avoid these troubles.

    In new york this is only considered a violation which is not a misdemeanor or felony,its probably just a 25 dollars fine. You were not fingerprinted,arrested or processed so chances are small it would even show up in a back round check. If it ask about being guilty of a crime you can put no. I have seen,have you ever been convicted of any offenses other then a traffic violation .

    Chances are since you weren't fingerprinted,arrested or processed a back round check won't see anything but you never know. Just read the question and answer honestly. It's such a minor offense that it shouldn't be a big deal,just don't rack offenses. Just be glad the cop didn't give you a 2nd ticket. I would just plead guilty and be done with it.
