My question involves independent contractors in the state of: Nevada and Ohio
I have been working with a publicity firm out of Las Vegas for the past 3 months. The guy who owns the business hired me as an independent contractor, and I have been working from my home in Ohio while awaiting the permanent move to Las Vegas.
My problem: the guy is not paying me. Our agreement, which I have in writing, was that I would get paid $600 a week -- $120 a day for working as a publicist for his company. I was originally supposed to get paid every two weeks, but after I started he switched it to the end of the month and only getting paid once a month. I started March 8th which should have made the first payment March 31st.
He has never paid me on time, or paid the entire amount owed. He claims it is because the clients are not making any money and he simply doesn't have it. Although I know that he has paid for services for his clients and he has paid to have car repairs made.
He has deposited sporadic amounts of money directly into my bank account over the past two months. However, I have done no work for him at all since the Middle of May, and since then he has only deposited $700 into my account. He still owes me $1460. I have not heard from him, and my emails have gone unanswered. He does not answer his phone when I call either.
Since I don't live in the same state as him, what can I do to recover the money that he still owes me?
I've been stuck living in a friend's spare room for the past few months because this guy has never paid me an entire week's pay, and he is still so far behind that I never know when or if I'll be able to pay rent on my own place. Now, I'm out of work, waiting for this guy to pay me, and trying desperately to find any job in a state where the unemployment rate is 14%. HE really screwed me over, and I need that money.
