    Default Alienation of Affection

    I live in NJ. My wife had an affair for about 3 years on-and-off. I had a break down when I discovered her infidelity and have now been diagnosed with Post Traumatic Stress Disorder and have had to take several medications along with many hours of therapy due to the affair ..... Can I take this SOB to court?

    The state of New Jersey does not recognize alienation of affection as a cause of action.

    Can I sue him for anything else???? After all I did develop Postraumaticstress disorder and have suffered immense amounts of emotional and psychological anguish due to the affair. Not to mention a 9 year relationship destroyed and a broken home for my 2 year old! there has to be something the legal system can do for me.

    You really should sue, damnit!!! Sue the pants (or skirt) off your wife. She is the cheating scum-sucking unfaithful moron who broke her vows.

    The jerk she cheated on you with had no obligation to you whatsoever, so heck yea...sue her - it is called DIVORCE (that is your legal remedy).

    She claims that she severed all contact w him......but recently he contacted her attempting to meet somewhere, she claims she turned him down so he sent her a picture of his penis from his cellphone to hers.... My 2 year old son loves to play with anything that resembles a phone and I believe he may have seen the picture.......idk how to go about this

    Start parenting your child, and consider divorce.

    And ask your wife why she hasn't changed her cellphone number if she no longer wants contact.....

    Go about what? Filing for divorce?

    Easy peasy - you retain a competent divorce attorney, write a check, and turn him loose.

    If you mean sue the boyfriend...no. One more time: New Jersey does not recognize alienation of affection as a cause of action.

    Your option is divorce. Or you could try the time tested method of beating the snot out of your wife's boyfriend to make yourself feel better, but then you'd need a criminal defense attorney in addition to your divorce attorney, and that stuff gets pretty expensive after a minute.
