My question involveaccident in Indiana, on a small two lane county road, other driver was following me and went to pass me since i was slowing down to turn left across the other lane into a inlet on a farmer’s field then back out to go back the other direction. Front tires were already in the inlet when he t boned me. i was hurt (bruised ribs healed in couple weeks) since the blunt force went into my side (driver). Cops asked me if I had my signal on, i told them i don’t know and was kind of in hysterics. Went in ambulance. after going back to site about 4 days later i remembered turning signal on at around this bridge approximately 100 feet back from inlet when i first saw the inlet but by the time i almost pulled into inlet my signal must have clicked off because i was already turning back my steering wheel or the force of being hit could have clicked off signal. of course the other guy said i didn’t have signal on. i can prove with pictures and video he was going fast enough to cause 50 feet of black tire marks from hitting his breaks and then i measured another 25 feet of pushing my van on top of the farmers fence. the speed limit was 40 and he claimed on police report he was following me at 15 to 20 when he decided to pass. How do i prove my innocence when police report didn’t take my sound statement? The statement reads that I said I didn’t know if I used my signal and the turn signal was in neutral position and that I made an illegal turn. Nothing about my hysterical state. I even called the on site officer the next day and he took three days to get back to me. Then he just put in there 'driver said she turned on signal right before inlet.' I wish i would have examined the site before the officer finally called me. Anyway i have pictures of where my front wheels were already pulled into inlet and of course video of tire marks and the impression of where my van landed. My theory is he was going really fast and saw no turn signal right before i did turn it on and already decided to pass. Well the atleast the 75 feet he needed to stop doesn’t really jive with what he said in police report about going 15 to 20 following mpr
