    Default eBay Purchase Fraud

    My question involves a consumer law issue in the State of: Texas

    I sold a PC video card on eBay to another individual in Texas. He paid via Paypal, funding the payment with a credit card. He subsequently disputed the payment, claiming he didn't recognize my name on his credit card bill. I not only was charged back for the sale, but also a $10 fee apparently tacked on by his credit card company. He claimed he had contacted his card company to make this right, but it's been a long time and now he no longer responds to my emails asking for update. Do I have any recourse? I realize it was a small amount - $45 - but it's the principal as well as the fact that I could use the money that is due me. Thanks in advance for any advice.

    This is why I don't do Ebay anymore. Lots of protections for buyers, virtually none for sellers. I don't know the answer to your question as to how to get reimbursed for what you're out, but I do know that this type of thing has become more prevalent in the last couple of years, and many smaller sellers have gone back to check or money order ONLY.     I'm considering cancelling my eBay and PayPal accounts over this.

    It also really irritates me that eBay doesn't allow anything but positive ratings of other users! I was going to submit a negative rating for this person but found I couldn't. I contact eBay and they provided some lame reasoning for it. Totally ridiculous. I went back yesterday thinking I'd give the positive rating but then warn people about this user in the comments, but I suppose it's been too long since the transaction for that to be possible.

    I used to do a lot of selling on Ebay but not anymore. I don't blame ya!

    Apparently the issue here is that his credit card accepted his dispute and either you failed to document the purchase or, for reasons you haven't shared, they didn't find your documentation to be sufficient - despite your apparently having emails from the buyer admitting that the dispute was made in error. That's not the fault of eBay or PayPal - neither of them are responsible for the decisions of your buyer's credit card company.

    Did you respond to the dispute? If not, why not? If so, why did they find against you and why haven't you followed up?

    Hiya Mr!!!

    Actually the problem lately is that sellers have no protection, it all goes to the buyer. Even when verifying a sale, and return receipt, as a seller, you can be tabbed. EB and PP are run by the same, and even when you are on the hook for your fees, you can't dispute a buyers actions. There are many complaining of the same.

    Nobody has disputed that eBay owns PayPal. But the buyer did not make a dispute through eBay. The buyer did not make a dispute through PayPal. The dispute was made through the credit card used to make the purchase via PayPal.

    I truly hope that he makes a dispute thru Ebay, and tells us of his results. I've tried, to no avail.
