    Default Employer Cut My Hours to 5 Hour a Week

    I quit my last job to take this new job at Beisto' (up scale resturant) as a bartender, everything was working great I was getting 30-40 hours a week and making really great tips. Well 2 Weeks ago a waitdress I work with pulled her breast out and let this dirty old man kiss on them and he gave her $180.00. (this is not a strip joint or night club) Anyway I voice out to my supervisor that it was discusting and I feel bad for her and the whole issue makes me sick to my stomach. This dirty old man once told me that I would have sex with him or I would never work in Tennessee. (but not while I was working at this resturant) He ownes local Toyato dealer ship here and is well known in area. He thinks his money can buy him anything.

    Once I voice to my supervisor my concerns he cut my hours to 5 a week. I cant live on 5 hours a week, and there is a pattern that over course of 2 yrs when this dirty old man finally finds out where I work he make his present well known and my hours get cut. I hate him and he follows me everywhere. He is making my life terriable... Can I draw partial unemployment if I cant get any hours.

    Yes, I am female and I am really cute, 5'9" with blonde hair and really thin, I been asked to hang out with the manager but I am not willing to hang out after hours or go out to any bars.... there has not been any quid pro quo statements made either, but I have made it clear to everyone I am here to work not play. now I dont get any hours. But the real thing is the dirty old man that kiss on the waitress on her naked boos then gave her 180.00 Once I verbal that that offended me and really nasty, my hours got cut right then, and the resturant owners want even listen to me when I complain telling me to confront the Manager with my issues ....

    I have been sexually harrassed by this dirty old man. (In the past) and he follows me around town. Then once he finds out where I am working he makes his presents known then my hours get cut... He told me if I did not sleep with him I would never be able to work here in Tennessee. I worked at Hooters when I met him, he tipped really well like 100.00 for just coffee. It was all good but in the long run he wanted sex and I told him no. Since then he harrasses me at everyjob I work at.

    This is a customer, not your employer, doing the harassing? He's following you around?

    Have you gone to the police to report his stalking behavior?

    Did you witness the customer with the waitress or is it just a rumor that he kissed her? If you notified your employer that you found the environment hostile, that could potentially meet the legal standard of hostile work environment sexual harassment. The sexual conduct does not have to be directed at you specifically to merit a hostile work environment claim. If the employer in return cut your hours for making the claim that you experience hostile work environment sexual harassment, that could meet the standard of retaliation even if in fact the original claim did not meet the standard for hostile environment. Employers are required to protect employees from sexual harassment from 3rd parties as well as their own employees so the fact the customer is involved does not negate your potential claim. If you have not already done so, draft a letter to your employer explaining to them why you feel sexually harassed and ask why your hours were cut. If you can send it by e-mail, do it. If not save a copy of your letter. Go from there.
