    Default Property Line Dispute in Kansas

    We purchased our house in Aug of 2005, in Ozawkie, KS our neighbors who have not built yet just had their property surveyed. Through the survey we found out that what the real estate agent that sold us the house said is not true. She said we owned more land than what we really owned. Also through the survey we found that about 5 foot of our basement wing wall is on the neighbor's property. There was an old satalite dish that was for our property (that we removed) that we were told that was on our property, but through the survey it is not. We have talked to our subdivision's office manager to see if we could purchase what land we thought was ours and they said that they will not split the lots.
    Is it legal to sell a property with knowledge that the house is not completely built on the lot that we purchased?
    What steps can we follow?

    Did you purchase title insurance? What did the survey show? How old is your house?

    I don't think we had title insurance, we did not have a survey done, It was a repo sold by a real estate agent that lives in this community. It was built in 1975.

    You can claim the property thru adverse possession but you will have to go to court in order to do so. Probably cost you 5000 or so and about two years if nobody decides to fight it.

    Should you sell the house, you should be up-front with the buyers about the property line issues. You may wish to investigate whether you can get coverage for resolving the boundary line issue through your title insurance.
