    Default 5 year bar or 10 year bar?

    Hi, My husband had a deportation order back on 1994. He was self deported one year later although he did not know he was deported. The reason for his deportation was because he was caught illegal entry, he applied asylum, but because argument with his lawyer, he did not appear at court. So the court gave him a deportation order for him failed appear. Does he have 5 year bar (212(a)(9)(a)(i)) or a 10 year bar (212(a)(9)(a)(ii))? Thank you.

    His deportation order should state the period of exclusion; or he may be able to find out from his former lawyer, the court, or the U.S. Border Patrol. But it's been more than ten years, so why does it matter?
