    Default Understanding a Student Loan Promissory Note

    My question involves collection proceedings in the State of: Calif.
    I have 14 doc's up on the web (My id blacked out) if anyone would care to view them...
    After over 22 years of asking for documents from Sallie Mae, collectors, etc. I finally got some!!!!
    The ones in question are all three from the original lender Nov. 18, 1987, Trans World Insurance Co., Sacramento, Ca.. The first doc is an Application for Promissory note, top portion filled out, dated, signed by me... This is the doc that I was sent when I ask for the original promissory note...on the back is a date stamp, barely legible, upside down on the top amongst the other terms... this date stamp appears to have only a partial word above the date of JUL 11 88.
    This same date stamp is on the OTHER Guaranteed Student loan Promissory Note... the one that is NOT signed nor dated...but the date stamp is on the front mixed into the words Trans World..... only a partial word and date of Jul 11 88...BTW THIS promissory note is the one I only recently received!

    The other same date stamp is on the front of School Disbursement Information... that is also unfilled out or signed/dated.
    These three doc's are all for one GSL of $2,625.00.... the other $4,000.00 loan was refunded back to the lender in April 1988, just as Muir said that they would do...
    If anyone might have a inclination what this date stamp might mean and why it would be on the front of these doc's. I would appreciate any help....

    LOL, I hope it says "VOID Jul 11, 88".... THEN I really will need legal help....

    I can't see any text associated with the upside-down stamp at the top of the note. You have posted a low-resolution scan, so we can see a lot less of it than you can.

    The documents are all bad before being scanned, the one on the GUARANTEED STUDENT LOAN PROMISSORY NOTE, at the very top, mixed into Trans World is the one that shows what is apparently the very bottom of 4 letters as does the SCHOOL DISBURSEMENT INFORMATION. I've cropped these, enlarged the three cutouts, flipped them and have uploaded them to the album, no other editing by me.... In your experience is there a reason for these stamps? The grace period had not expired yet (according to them!)...

    Also, another question that "THEY (collectors, etc.)" are having difficulty answering is why the school would refund $4,000.00 of a $6,740.00 enrollment cost, when according to "THEM" I attended about 75% of the enrollment period, it was a six month class and would have ended 5/13/88... "they" certified that my last day of attendance was 3/30/88... only six weeks left!! LOL....I would speculate that the refund didn't show up when they certified over 60% attendance....

    Some of my prior questions have been answered with these added documents.
    In my searching I found that a "common application/promissory note" did not come into being until after 1992 according to the Ed handbook. Until then an application and a separate GSL Promissory note were used, as evidenced by there being two identical GUARANTEED STUDENT LOAN PROMISSORY NOTE that I received. One from ED and the other from Sallie Mae, both UNSIGNED/UNDATED. Can't claim forgery on these, there IS NOT A SIGNATURE at all.

    The question of the LDA (last day of attendance) has been clarified. Several change of status forms (From SM) show my LDA being 01/88. This was changed to 3/88 on two other forms and finally Certified as 3/30/88 by the claims analyst at Student Loan Servicing/Kansas, in Aug. 1990. Over 2 mos. added to a six month course, put it over the 60% mark.

    I now have two identical Repayment obligations, one from ED is unsigned/undated. The one from SM is "signed/dated" ????

    I also have a barely readable copy of a check that was suppose to be made out to me, that is stamped "NOT NEGOTIABLE" in the signature area and I didn't get a copy of the back of it. The date, amount and bank are not legible.

    There are far more questions then answers... BUT I do better understand a promissory note, especially since I have proof from them, that I did NOT sign it or date it... WHY would it be in my file, with the lenders information, loan information etc all on it... IF I wasn't suppose to sign it when the funds were disbursed?

    There is also an interesting "request for Check" form that shows how the school tried to get the "other half" of the money... after I was gone... which explains the $4,000.00 refund better.

    BTW all of the players in this were investigated, sued and charged during the early 90's... I even have in my file (from SM) the newspaper articles that I referred them to, stamped with the date and my SS#.

    I am still investigating this and finding new stuff all the time, of course being in my "golden years" I really would rather be fishin, but its hard to have a good time in retirement with constant calls and letters about a debt I don't owe disrupting my serenity... Its only been 22 plus years, I should be able to claim them as dependents on something...LOL Judy

    I have progress way past understanding a promissory note, which was NOT a promissory note to start with. I have a check that has not been cashed. stapled to a unsigned promissory note, that has been used to try to collect this debt from me. The check was never cashed, they can not come up with a copy of it anywhere, the only copy is of a check that was stapled and paper hole punched to a unsigned promissory note...I recently received from Sallie Mae.
    I've uploaded documents with a few explanations as to how they pertain to this debt. I would really like some one that is interested in pursuing a legal suit against THEM...

    Update: I received about 30+ more doc's from Ed Depart. among them were 9 pages of the actual Sallie Mae claims package.. It lists two grace dates, 2/1/88 and 3/1/88 but with a Separation date of 3/30/88... Shows my being Delinquent in July for 5-17 days (as 1st delinquency) So that puts my LDA in DEC. just as I have claimed all along...I also received a clear copy of the front of the "check" it has a stamp on the back (6 Nov 23 10:32) but there is NOT any sign whatsoever of any signatures showing through of mine or Muir Tech's.
    There is still a lot more I'm working on..How my signature ended up in the lower left corner, but it is right below the "letterhead" of Muir with a written in "student signature" between the line and letterhead...
