    Angry Denied First Time Home Buyer Tax Credit, Claimed As a Dependent

    Hello, I was denied the First Time Home Buyer Tax Credit. ( because someone has claimed me as a dependent.)
    I am 20, I just purchased my Home in Lafayette at age 19, closing date was January 9th, for 85,900.
    My parents claimed me and had no right.
    I am independent. I am not a student. I am not disabled. I have completely supported myself since january 2008.
    I have only seen my parents 2 times since August of 08, at a relatives wake, and funeral. I Have MY OWN HEALTH INSURANCE!
    Is there a way to redeem my tax credit???
    I would like to hope my parents would be at fault and would suffer serious consequences...

    You would need to find a way to prove to the IRS that you were NOT your parent's dependent for 2009. What kind of earnings did you have in 2009?

    If you were not a full time student in 2009 and your parents did not provide your support then their claiming your dependent exemption will not stand. You simply file your return, claim your own exemption, and file for the FTHB credit. If the IRS has still disallowed the credit then follow the appeal process described in the letter you received. You will need to establish to the IRS that you provided over 1/2 of your own support. That will establish conclusively that your parent(s) have no right to your dependent exemption for 2009.

    Alternatively, since you closed on the house this year you can always claim the credit on your 2010 tax return.

    I am in a similar situation. I just closed on a home this week and graduated from school last year. My parents did claim me as a dependent last year in 2009 but I want to be able to get the 8k now. Is it not possible? I am working full time now and self reliant. Can I just not have any federal taxes with held from my paycheck to get the money back over the year?

    Any advice is appreciated.

    Claim it on your 2010 return. I would recommend that you leave your withholding alone and do not "anticipate" the 8k credit. Should something go wrong and you don't receive it, then you would have a problem.
