    Default DUI Not Prosecuted for Over One Year

    I was arrested in the state of Missouri for DWI on April 5, 2009. I was ordered to appear in court on April 7, 2009 to answer to the charge. I did show up for court on that date and at the proper time. However, my case was not filed. I was then released.

    I was told that they up to one year to file my case and I would be notified by mail, Sheriff's office, or other serving agency about a new court date. I never heard anymore about it.

    After one year has passed, I investigated the matter and found out they file my case on April 10, 2009 and they have had a warrant out for my arrest ever since.

    Is there anything that can be done to expunge this whole mess, or can they still prosecute me?

    They filed the charge on time, so it's not barred by the statute of limitations.

    Was your address accurately reported to the court? Have you investigated to see why you didn't get notice of the proceeding, and what is reflected in the court file in relation to how you were notified of the court hearing that you missed?

    I found my case on case.net. All it has is that the charge was filed and a bench warrant was issued. Other than that, they never made any attempt to contact me. They have my proper and current address.

    Hire a DWI attorney to look into it and probably defend you. We can, at best, guess about what has happened and that will do you no good.
