My question involves real estate located in the State of: Texas
My neighbor just put up a new 6' wood fence on her side of the property line. At the time there was a chain link fence on the property line that we both agree is the propery line. This chain link fence was damaged due to a tree that was on her property and she had the tree removed but wanted to leave the chain link fence. She states that she wanted to keep the fence because she paid for it some 50+ yrs ago. After her new fence was up the chain link was an eye sore to my side of the property and a maintenance issue between the fences. So I removed the chain link because it was damaged. Now the problem is she wants me to pay to replace the chain link fence. Did I have a right to remove the fence since she put up another fence? And if so, please point me in the direction to the proof I need that this was a common fence. Thanks!
