My question involves an eviction in the state of: New York
I am the leaseholder of this apartment shared with a roommate who is not on the lease. When she moved in, we did not draw up any contracts regarding her length of stay, rent, etc.
Relations have gone sour between us and I have asked her to move, but she told me she can't afford to leave, and since then has aggressively refused to communicate with me at all. Luckily, my lease expires on June 30, 2010, and I've decided not to renew the lease so I can move out and live on my own. I do not want to spend the time and money on trying to evict her.
I am wondering whether, once the lease is over, if I have moved out but she hasn't, will she be my responsibility or will my landlord have to go through court procedures to evict her? It will be impossible for her to pay the full rent once I'm gone. What will happen to her and will I face any penalty for her failure to leave once my lease is over?
