    Default What's On a Criminal Record After Adjournment in Contemplation of Dismissal (ACD)

    My question involves criminal records for the state of: New York

    If somebody accepts an ACD in the State of New York:

    -Will there be ANY record of it on a background check in, say, five years?
    Everything I am reading says the whole case will be dismissed and sealed, but what would officially show up on my record, for the rest of my life?

    -Is this THE SAME as "deferred adjudication" or "pre-trial diversion"?
    After doing some surely amateur-ish research, I don't believe it is because with an ACD I never would plea guilty to the situation.

    The ACD is a type of deferral, and it results in your record being sealed.

    Does that mean nobody will ever be able to find out about your record? No. But if they obtain a copy of your criminal history from the state, the charge shouldn't appear.
