    Default Proof of Ownership With No Deed

    My question involves real estate located in the State of: PA

    I've been living on land 31 years purchased by my father in 1957 in a small mobile home community - where half the individual lots were sold to individual owners and the other half continue to be rented by the original owner of the mobile home community. My father wasn't able to secure the deed after paying in full for the property and therefore could not will the property to me. Most of the individual owners had to each go to court to get their deeds once their property had been paid for in full.

    I'm trying to find out how I can get the deed for this property. Additionally there is a second issue now regarding this property ownership as a few months ago the township ordered all property owners must be connected with the incoming sewer system - of course this is at all property owners expense. Anyone in this mobile home community that rents their lots are not responsible for the hook up cost - the property owner is responsible. However I am neither considered a property owner as I have no deed nor am I a renter and of course as my father paid for the property in full.

    I am looking for information on how to secure this deed and also as to what my responsibility is in regards to the sewer hook up as long as I don't have the property deed and I'm not a renter either.

    The title is in somebody's name. Who presently holds title?

    This promises to be complicated as not only is the chain of title incomplete, it sounds like the property wasn't included in your father's estate and thus there was no grant of the property to you by the probate court. I think you're going to need a lawyer to straighten things out.

    The person/company my father purchased the land from still has the deed to the property but I have proof of purchase and that the property was paid for in full.

    The property obviously could not be left to myself or my sisters as my father hadn't gotten the deed to the property prior to his death.

    I presently hold the title for my mobile home that sits here on the property for the past 31 years as well as have lived here for the past 31 years.

    Have you inquired with the owner of record about conveying the property to your father's estate?

    I have been trying to get the deed from the seller for 31 yrs. to no avail. Everyone who bought land here , had to take the seller to court to fight for their deed. I have all the proof I need to prove this land was paid for, besides living on it for 31 years, without anyone asking for money, or telling me I have to get off.

    so, go to court like so may others had to.

    In your case the fact it is really your father who has the right to sue and is deceased will cause some problems in the situation, you might consider an adverse possession claim. I would speak with an attorney that deals with real estate to discuss your options.
