Well I am looking to have my case evaluated, but all of the attorneys with the specialization on the Vioxx case won't even talk to me, because of the cause of death listed on the death certificate. The family believes that my father died of a heart attack, because he just drove off the road and got unlucky and hit a concrete property maker buried in the ground that flipped the car. This one car accident that my dad died in instantly is routinely classified as head and body trauma. The county does not want to spend the money to send the bodies away, because at the time the county did not have and medical examiners. The cost for the county was prohibitive unless they thought that there was something amiss.
Now it has come to be found out that Vioxx causes hart attacks. My dad was taking Vioxx, he was on the drug for six months to a year, and he thought the drug was a miracle because is got rid of the pain. The dates of use are still not exact, because I am still trying to pry the records from the clinic at his work. . I have quoted the state law to have the records released, but the clinic is still not complying. I am giving them one last week before I report them to the local state medical board.
So, the family has contacted lawyers and they all say since the death certificate cause of death is head and body trauma from the accident, and not a heart attack they can do any thing. In order for them to take the case we would have to have an autopsy done and show a heart attack. This would cost about 7K or 8K
Here comes the question, in order to not waste the money I am trying to collect the record and get them reviewed. Once I get these record how do I get them reviewed and determine if I should get the body exhumed and autopsied? Basically I want to know that if this is taken to court, and if he died of a hart attack, and there were no other contributing factors to give the Vioxx company something to hang there hats on, other than family history.

Other info Aug 1994 is when the product was found to cause heart attacks a fact not be listed on the harmful effects. Statute of limitation would be two years. Not sure if my stint in the Middle East, 9 months, for the military would extend this date.
My grand father died of a massive heart attack at the same age. This was a fact that my dad was very paranoid of and worked very hard to not have this happen to him. They had totally different life stiles and eating habits. His father worked two jobs, both his own companies and had a severe temper.
