    Default Support Obligation

    I was reading under the new Tennessee Child Support guidelines that if either the mother or father willfully quit their job for a lower paying job for part-time hours that the court will consider what that parent is capable of making as to the income they are getting at the lower paying job.

    That is the problem we are coming across. The mother of my fiance's daughter quit her job to lower her percent of support so he has to pay more. She has had jobs paying $11 to $12 an hour also. I read that the court has to calculate what she is capable of making instead of the lower paying job she is purposely working.

    Has your fiancé asked the court to impute a higher income?

    We talked to an attorney and he said that they are going to subpoena her to report her last three jobs. He was so nervous and the woman who set the child support wouldn't listen to anything he had to say. We have to hire this attorney to get this mess straightened out, because we have spoken to two attorney's now and each one said that the child support agency screwed him good because he was a man. So wish us luck the attorney we are hiring said we have a case. I'm just tired of the man getting the worst end of the deal.
