Default How Long Does It Take To Get a Divorce
illinois i moved back here with my children in aug 2007 after splitting with my wife of five years. how long do i have to live here before i can file for dvorce? neither of us have any plans of getting back together, and the sooner we get this done the better. we dont want the kids to get their hopes up that their mom and i will reconcile( we're not). ive had physical custody of the kids for the last two months, and their mother keeps in contact with them by phone, and she has come to see them once not long ago( i told her she can come here to see them, or i can bring them to ny to see her, id never deny her the right to see the kids, they are her kids too). we have yet to get a seperation agreement.will taking them out of state work against me, even though my wife gave her permission for me to take them?

There is no minimum waiting period specified in Illinois law, between the filing for divorce and the granting of a divorce. Your ex- may be able to force the custody litigation to be resolved in the former state until you have been in Illinois for six months.
