My question involves defamation in the state of: California

Last year, after hanging out with an ex (I hadn't seen them in over a year) one day that included some heavy drinking, I blacked out and woke up the back of their car alone the next morning confused and scared, not knowing where I was and what had happened. I immediately got a ride to the police station where I then told them what I remember and that I don't want anything to come of this situation. I didn't make a statement or file any charges, I just wanted to walk away from this. He (my ex) later told me that I was falling around, incoherent, and they had to carry me around that night. He then told me that we had sex in their car that night, which I don't remember and he left me in the back of their car. But still, I didn't want to file any charges or anything.

We still kept in contact, but recently, when I called them he said his lawyer would be contacting me because now they have some kind of record that's keeping them from getting employed all because of what happened last year. I'm confused because I made no statement and I didn't make any charges. I still don't want to, I don't want to harm them.

My question is, can he sue me for defamation? I made no statement with the police or charges against him so I don't know how this could of happened. I'm worried that if he does, this could be in the papers and I would be opposed to that. Also, I don't have any money so I don't know how he can sue me, I don't even think I can afford a lawyer. Any advice would be much appreciated.

Can I be sued for defamation or anything at all?

Thank You

My question involves defamation in the state of:

Hello this is my first post and I'm in an interesting situation. I was dating this guy for a few months. I trusted him completely. I went on vacation and found out many things that were really bad.

The first one was that he charged over $1k to my credit cards without permission. I noticed this while I was on vacation. When I came back there were many things suspicious. I didn't confront him right away bc I wanted to investigate and be very sure before talking with him. While he was sleeping I went through his phone and did see the e-mail receipts from the taxi service with the last 4 digits of one of my credit cards.

Not only that but I saw that he was cheating on me the entire time. I saw his emails for sexual encounters on craigslist during the entire time we were dating. I figured that the taxi charges went back about 3 weeks and the dates corresponded with his sexual encounters. So he was using my credit card to pay to get to his sexual encounters.

When I discovered that my feelings took the best of me. I texted three of the people he had sex with and said "btw I'm hiv positive". I did it mainly to get a response to verify whether sex had occurred. I got a few responses such as "well we used protection" and the other one was "we didn't go all the way". That was confirmation he actually had sex.

After all of this I confronted him and he admitted to using my credit cards. I kicked him out. He said he would pay that money back.

What concerns me and the reason why I'm writing this is because one of the persons I texted is considering pressing charges against me for slander!!! I was seriously considering pressing charges against my ex for fraud but I feel like I'm being black mailed into not pressing charges bc they will against me.

I'm really concerned that he won't pay because he is a compulsive liar and I spoke with his family and apparently this is not the first time he had done this. He had stolen over 2k from a family member using their credit card.

I would press charges on him without a thought but I'm concerned about these slander charges for sending these texts. Could someone please advise me? Could these slander charges really stick? Or should I not worry about it and press charges against him?

Please help.

My question involves defamation in the state of: Washington State

I bought a horse and decided it was best that I sold him due to a job loss. While trying to rehome him I had a person who I do not know start to harass, slander and threaten me about it on facebook, on another site where I found the horse from and through email. I have never been in this situation before so I did not go to my authorities yet. I have since come to found out though that one of the officers has mentioned my name and has been saying things to another party who informed me about it today. I don't know this person nor do I know how this officer knows me as I have never been in trouble with the law.

Because of the overwhelming stress and bulling from this person and a few others I ended up surrendering my horse to a local rescue group. This has really effected me mentally and ultimately has damaged my reputation.

I have never had this happen before so I'm at a loss of what to do. Is there anything I can do? Can anything be done about the officer? This has all happened recently.

Slander: Woman Claimed That Police Officer Raped Her

I am a Police Officer in Kentucky. Yesterday while transporting a female subject to jail, she made the statement that I raped her and that I was a rapist prompting an investigation to ensue. This all happened while my video camera was on and recording.

She retracted her claim following an interview from one of our command staff (her statement retracting her claim was also on video). Nonetheless, a report had to be taken in accordance to our policy.

With that said, this really upsets me because for one I was accused of a crime in which I didn't commit; furthermore, everything we do as a police officer is recorded, documented, and then eventually becomes public record when requested. And what this has done is put a mark on my record that I was accused of rape.

What are my options?

My question involves defamation in the state of: California.

As part of several program applications that I sent out, my current school was required to fill out a reference on my behalf. The person filling out the form carelessly marked me down as 1) having received disciplinary action at school, and 2) having been convicted of a crime. Neither of these statements are true. I believe that they did not do it on purpose, but rather were negligent in failing to read the form properly. It is several months past the application deadlines, and even though I have tried to rectify the situation with the places I applied to, I feel that it is too little, too late. (These programs are very competitive to get into, and even if admissions reviews my file again in light of the correction, it is very likely that spots are already filled, although I am quite a strong applicant). While I do not yet know the outcome of all my program applications, I am very upset and worried about the implications of this mistake. Do I have any grounds to pursue legal action in this case and should I?

My question involves defamation in the state of: Pennsylvania

I was a professor at a small liberal arts university in Pennsylvania. A student falsely accused me of sexual harassment, and the administration subjected me to a resolution procedure that violated my rights under both US Law and their own policy. There was absolutely no due process, and I've never been allowed to examine statements against me, despite repeated requests. The resolution focused more on my mental health (which they had no reason to doubt) than on the facts of the case. They either failed to discover or failed to consider the fact that the young lady had spent months trying to engage me in a romantic relationship.

Much later, I found out that my accuser had a history of attention seeking behavior and possibly mental illness. The university's investigation was pretty sloppy, and they failed to uncover this fact. This violates the OCR's rules regarding complaint resolution processes, which specifies that the investigation be unbiased and thorough. Once hearing about this from other students, I turned this young lady in to the Dean of Students, and asked that he get this person some psychological help.

Even though they found that I had not violated any university policy, they still made it pretty clear that I was unwelcome at the university any more, and they refused to re-hire me for this year.

I have been searching for another position, but I suspect that my former employer is trashing my reputation behind my back. My colleagues have all written glowing letters about me, but I am concerned that the HR department or the provost's office is releasing information about the case, either during background checks or through private communications (i.e. chatting on the phone with the provost from a perspective employer).

My questions are:

1. What information is my former employer legally allowed to share with perspective employers regarding the accusation and the complaint resolution process? The university's own policies guarantee privacy rights for persons accused of sexual harassment. How does this affect what they are allowed to share?

2. Is there any way for me to find out what they are sharing with other universities (preferably something other than the discovery process if I decide to sue)?

3. If I find out they they are bad mouthing me, what action can I take? Will this extend the deadline for me filing an EEOC complaint? Can I get an injunction barring them from sharing this information with other schools?

My question involves defamation in the state of: New Jersey.

I just received a call from my girlfriend about a conflict she is having with another student at our university over Facebook. She called because the other student just threatened legal action.

It all began when he made a post on his wall attacking a rapper which led to my girlfriend accusing him of being a racist, to which he replied "Maybe I am a racist. A lot more shit got done in those days." He deleted the entire conversation from his wall, but not before she took a screenshot of it. Since then, she showed it to a friend, who has been showing it all around the admissions office where they work.

Now he just contacted her saying that he spoke with his lawyer and that if the screenshot keeps going around he will sue her for defamation. He states that he took all measures to make sure the statement wasn't seen and "misconstrued" as discriminatory, and now she's the one causing trouble. She doesn't want this to go any further but I'm afraid it's out of our hands now that the photo is in the possession of other people.

Does he have any grounds for this sort of thing? Isn't anything put on a social media site completely public? Where do we stand in this situation?
