The county I live in is accusing me of zoning violations.  I have read the codes in their complaint, and do not believe I am in violation:  Their procedure does not allow me to defend myself and present evidence to support my innocence, and in fact, to get this resolved, I must sign an affidavit admitting to these violations, then go before a hearing officer to determine my punishment and see if I will be able to clear the violations.<br />
<br />
I think that by not allowing me to present evidence in support of my innocence, my right to due process is being violated.  Also, by forcing me to sign an affidavit acknowledging my guilt, I believe the 5th amendment prohibiting forced self incrimination is also violated.  <br />
<br />
Am I right, and if so, what do I do?</div>

			<content:encoded><![CDATA[<div>My question to you is how is the part of the Firearms Owners' Protection Act of 1986, that bans the civilian ownership and transfer of fully automatic firearms manufactured after 1968 constitutional? The second amendment clearly states &quot;shall not infringe&quot;, now you can say that the NFA Act is possibly unconstitutional as well but seems to more or less fall under the governments right to tax, but the FOP Act seems to clearly violate the constitution. I want you to put your political (left or right) feelings aside and take this from a strictly constitutional stand point and give arguments as to wether it is constitutional or unconstitutional. Also share your feelings on the NFA act, because the right to tax is one thing, and 200$(although it was back in 1934)is not enormous today but it is a pain, however can you say that the wait time from the BATFE of 6-12 months is not an infringement on your rights? <br />

I was wondering how to name the retired Sheriff who was over seeing the department during the time of a wrongful arrest. I have had a suit going on for approx. 2 years and just found out the Sheriffs changed hands about a month after I was wrongfully arrested. He would be named in the Negligence in hiring and training aspect of the lawsuit pending. This is for an amended complaint I received leave to amend from the judge presiding over the case.<br />
<br />
I have written him in as &quot;formely operating out of&quot; the address of the Sheriff's department. My assumption is that he would be covered under the city's lawyer who is defending the case currently and the city's liability because he was employed by them, but I do have that I am suing him in his &quot;municipal and individual capacity.&quot; I have had some lawyer help on this but not full time and I do not have access to one cheaply. I just do not want to run into the problem of incorrectly serving someone named in the complaint and have my case thrown out. Any help?</div>
