<br />
Hi,  We currently rent a 2000sq ft commercial unit (flex space) and the owner has decided to invoke his right to move us within the building.  We have 1 year left on our current lease but also have the right to renew for an additional 5 years at the current rent (plus a 3% escalation)<br />
<br />
The unit he want to move us into is 3150 sq ft and needs ALOT of work to be &quot;equal&quot; to our current unit.  I am attaching the appropriate section of the lease:<br />
<br />
<i>	§3.04	Relocation.<br />
	The Landlord shall have the right from time to time during the Term, at the Landlord's expense, to relocate the Tenant's Premises from its present location within the Building to another location within the Building or other buildings within the same complex having at least the same floor area, provided that the Landlord gives the Tenant written notice of the Landlord's intention to do so at least 60 days before undertaking such relocation.  In such event, the Landlord shall, at the Landlord's expense, install within the Premises as so relocated improvements of the same quality and quantity as those made by the Tenant or the Landlord to the Premises, and on the completion of such installation shall cause the Tenant's machinery, furniture, fixtures and equipment within the Premises to be moved to the Premises as so relocated.  Upon the completion of such relocation, this Lease shall automatically cease to cover the space constituting the Premises immediately before such relocation, and shall automatically thereafter cover the space to which the Premises have been relocated, as aforesaid, all on the same terms and subject to the same conditions as those set forth in the provisions of this Lease as in effect immediately before such relocation, and all without the necessity of further action by either party hereto.  Also, the Base Rent shall be adjusted on the basis of the per square foot rates otherwise in effect, and the Tenant's Proportionate Share of increases in Real Estate Taxes, Insurance Costs and Operating Expenses shall be proportionately adjusted, to reflect any difference between the size of the Premises prior to relocation and that after relocation.  Each party hereto shall, promptly upon its receipt of a written request therefor from the other, enter into such amendment of this Lease as the requesting party considers reasonably necessary to confirm such relocation.</i><br />
<br />
Our main concern is that the base rent will skyrocket based on he per sq ft difference.  This increase will be detrimental to our bottom line and our business can not support the raise in rent.  He has stated he will not raise the rent for the remainder of the original lease (1 more year).  We are kind of stuck because we are forced to move but he is also forced to build out the new unit.  Then if the rent goes up we will need to move again!  <br />

No Waiver: The Landlord expressly reserves all rights against the Tenant, including the right to terminate this Rental Agreement, not withstanding the Landlord's acceptance of late payment of Rent from the Tenant, or acceptance of performance by the Tenant, other than for payment of Rent, that varies from the terms of this Rental Agreement.<br />
<br />
Does this enable to the Landlord to tell me vacate the property whenever in the middle of a contract period? He does give me 60 day notice. But the lease agreement does not expire till Sept 30. What are my rights?</div>

Our family of 20 has rented a beach house for 1 week beginning tomorrow and our rental agent disclosed to us YESTERDAY that there is beach restoration ongoing that may affect our beach access for a day or two. Upon visiting the property today, it was clear that direct beach access will likely not be available the entire week, and, the project has been ongoing for quite a while.  Our view is also obstructed by machinery and large steel pipes extending about one eighth of a mile down the beach. Apparently there is an &quot;act of government&quot; clause in the agreement which covers the property management somewhat.  My question is, if this has been an ongoing project, shouldn't this information been disclosed sooner?  Is there any legal recourse since we are not getting what was advertised?<br />

I'm very frustrated. Please help.</div>

We just moved into a home about two weeks ago, and while we have provided all payments and paperwork required by the lease (and have a signed lease), the broker / property manager has not removed the lockbox on the front door.  He has said multiple times that he will remove it, but has not done so.  The last time he said he would come out and remove it was about 6 days ago.  The only mention of a lockbox in the lease is for the last 30 days of the lease if we do not agree to renew, this tells me the lockbox is there unlawfully.  The property is NOT listed on the MLS, but to me that's neither here nor there.<br />
<br />
What recourse do I have?  Can I remove the lock on the front door (thereby also removing the lockbox)?  Can I withhold rent until it is removed?<br />

I have just moved into a new duplex and at the time my April rent was due my landlord was on the premises.  I tried to hand deliver the rent but he insisted that I mail the money orders to the specified PO Box he has.  A week or so later he came stating the rent was not received and if not given to him with the late fees included he would hand me a 3 day notice.  I borrowed the money and paid him in the meantime I contacted Western Union and was told the Money Orders had both been cashed.  I have copies showing what was written on the MO's before they were mailed.  The information on them now is not the same.  I am in the process of following the necessary steps from Western Union but was told it could take 4-6 months before I could receive anything back.  My landlord is not willing to work with me regarding this issue even though he has seen the paperwork I am filing.<br />
<br />
Upon moving in I had to pay first, last and a deposit is there any way those could be used towards my rent for May?  It is not easy to come up with another $850 to replace the missing rent.</div>

I am staying in the apartment more than 3 years . I am getting a very bad smell in my master bed room . People inspected and found that this is due to some dead animal and they where not able to find it and remove this . Every time they came and do some sprays. When I went to complaints to this to manager of the property and she asked me to leave the office and you need to stay in the apartment . Even  after many communication through mail , I never got any reply from her.<br />
<br />
I am staying with my kids in the apartment . I need some advice on this . <br />
<br />
   If I move the apartment after giving a notice , is this will be a lease breakage.<br />
   Where I can go and complaint about this . <br />
<br />
I am here on a work visa .<br />
