My question is if someone files for a TRO, does that go on your record, especially if the RO is never granted or both parties abandon the court hearing.</div>

In june 2007 I was convicted of domestic violence, I received a deferred sentence and 1 yr probation...upon the completion of the deferred sentence and probation it was expunged...I have the right to vote and have done so in the past 2 elections with no issues...my question is if I can legally own and or purchase a firearm under federal law...I have read a lot of websites and some have said yes because of the expungement I am able to and others say no because of the conviction...can someone that is actually knowledgable in this area please help me understand the issue I am having? I was caught on my campus a year and a half ago with 1/16 an ounce of Marijuana and a pipe. The paraphernalia charge was dismissed, but the possession charge was not. It was reduced to a $175 fine, which the DA said was to cover the court cost. I paid the fine, and I went through a program at my school which required me to see a drug counselor (she thought I was fine). But to find a job I need it off of my record. I was 22 when I was caught, the application for expungement asks if you were under 25, so I think that helps. However, I do have an underage drinking charge on my record as well, which is from 4 years ago now. I am wondering whether anybody knows if I am likely to get an expungement or not.</div>

During that time I was convicted of misdemeanor breaking and entering an auto in 92. FL law states that in order to obtain a Class G permit for a weapon &quot;which is for work purpose&quot; that you must have your gun rights restored in the state where the offense took place. It also states that it happened within the last 20 years. I am now past that mark so am I required to have the rights restored in NC? Also if so, what steps are required of me to have it started? Any help with a starting point or instructions on the entire process would be greatly appreciated.</div>

Hi,<br />
I am trying to help my nephew to see if he can get some charges removed from his record.  He is having a hard time getting a job after he was layed off.  here is what he has and the dates below.  I want to see if it is possible, is it possible to get both or only one removed. And if one which one and if possible please advise me the steps that he can take to do so.  If it involves hiring a lawyer then he can not do it as he has no funds.<br />

5-13-2010 (incident date) 4th degree assault 10-8-10 was the court or filing date I think I am not sure if that matters but I see he had that written down.<br />

Arrived, they sided with her.  At that point I got angry and got into an argument with the officers because,<br />
 Here I called the police for help and they did nothing. At that point they charged me with disordley conduct and<br />
Said that they were arresting me, I was tackled by three officers to the floor and because<br />
One of them had his knee on my back, I slightly pushed back. And was charged with resisting arrest.<br />
They dropped the disorderly conduct charge, but charged me with a count 2 misdemeanor for resisting arrest.<br />
Now I'm looking to work in the police force and need to expunge my record is this possible? <br />
Is that going to prevent me from being hired even if I am able to expunge the record? <br />
Because they do not allow a count 2 misdemeanor?</div>

Briefly, I was recently recertified as an SRNA in Kentucky. Unfortunately, I accrued six public intoxication charges during the time period of 2000-07. Three are ten years old or older. The director of the felon reentry program here in Lexington, KY told me that the old ones are expungeable through the EOC. No idea what that stands for; my Google search was not productive.<br />
<br />
The nursing homes here do not consider me hirable. From what I've been told, the expungement of the old AIs would increase my hirability. I do not have the money for an attorney, and could use all the help I can get to improve this situation and get back to work. I have been sober for almost three years.<br />

My son was riding with a friend and they were stopped for speeding and the police found small amounts of marijuana and a pipe in their vehicle.<br />

Both boys were charged with Possession of Marijuana and Possession of Drug Paraphernalia.  His friend was 17 at the time and there is nothing concerning this on his record.  My son was 18 at the time and he didn't get notice of a court date and a year went by and they had lost the paperwork but it still went to court.  They told him that the charges were being brought down to an ordinance violation vs a Misdemeanor.<br />
<br />
I thought that was a good thing, that although he did something wrong, it wouldn't hurt him in the future as far as jobs, etc., he wouldn't have a criminal record.<br />
<br />
He recently applied for a job and was terminated when the background check showed charges on his record for the offenses.  He has been turned down for other jobs but no one has ever provided a copy of the background check until now and he just thought he didn't meet the requirements of the job.  The application for the job that terminated him asked whether he had ever been convicted for a felony or a misdemeanor and he answered no, which is correct because he had not been, it was charged as an ordinance violation.  Looking at the background check you cannot tell what level the charge is, it just states conviction for Possession of Marijuana and Paraphernilia.<br />
<br />
I am wondering if this might have been an oversight on the part of the county clerks office.  I am trying to figure out what he needs to do now to not have this show up on his record as if it were a criminal charge vs. an ordinance violation.  Should I contact the county clerks office or do I need to contact a lawyer to help with this.<br />
<br />
Any advice would be greatly appreciated.</div>

I was arrested with about 0.6 grams of marijuana in Texas. The last two times I went to court they 'reset the date' so now I don't go back until early October of this year. I was wondering if I would qualify for deferred adjudication. My lawyer said he can bring it down to a class C misdemeanor. I was arrested with three other kids and they don't even care about their future. I'm trying to do all I can to undo this mistake. Will medical schools see that I was arrested if I get a non disclosure after deferred adjudication? I need help on this issue. This is dragging on way too long. If I do get the conviction of class C misdemeanor paraphernelia can I get it expunged? Please tell me what my options are because I haven't been convicted yet.</div>

In 2009, I was arrested for pushing my ex husband.  Of course this had to do with divorce proceedings. No one was hurt but I pushed my husband and he was adamant that I be arrested. I am the one who called the police. Anyway, this was several years ago.  At one point I was going to hire an attorney to expunge this record and he said he could expunge both, I never had the money., but since I have represented myself before in court later on in divorce proceedings. I believe I can do it on my own with a much lower cost , if I just know the correct steps. <br />
<br />
I have read everything I can to see if I am eligible. I believe I am.<br />
<br />
1. the charge was 784.03 (1)a  <br />
    1a. question, is this considered a domestic violence charge when nothing is mentioned about it being domestic in the records other than the arresting report that states it was my ex husband?   1b. or is it just considered a battery charge?  ( reason I am questioning this is because I am trying to get a license for a healthcare worker and cant quite figure out from the Florida statute if a misdemeanor 784.03 1 a that was nolle prosequi is exempt from disqualification . I know that a felony or any domestic violence has to go up for review, and I believe it would show up on level 2 background, but I don't know if they take into consideration that it was nolle prosequii and a misdemeanor. The Fl statutes arent' clear on whether I would be disqualified. I know you can file exemptions on felony charges, but it was not clear on the misdemeanor.       2. The final outcome of the case that I was sent to pre trial diversion, and completed the necessary steps, and at the end it states that the final outcome was<br />

I have never expunged a record. I have never had any previous or prior charges.  In this same time period, I was arrested for DUI 1st offense.  ( long story, blew 0, used my divorce attorney who felt it would be easier just to accept a wreckless driving charge... I should have fought it, but was too exhausted from all the divorce hearings etc, and   It was reduced to a reckless driving charge and adjudication was withheld. <br />
<br />
From my understanding after reading several websites,  I would be eligible because the reckless driving charge was adjudication withheld.<br />
  Is this true?  Can I also get the reckless driving record expunged because adjudication was witheld or not?  I do not want to waste time doing something that is not possible.<br />
<br />
Can you direct me to a specific website that states step by step process. I do understnad that the Clerk of Courts has a package, and that I have to do certain processes like having a background check , etc. I have no problem with getting the package , etc. and following these instructions, but don't I have to file motions, set court dates etc.?<br />

which is better getting the  record sealed or expunged, or does it matter, and are the processes differnet?   Can someone direct me to a specific site to step by set court proceedings besides the packet that I can get at clerk of court that I can figure out how to file the motions, etc.  <br />

Is there any other means of getting a copy of this certificate. My conviction was in 1999 and it was for a misdemeanor for Larceny, do you think this will cause an issue to entry<br />

I was working in a department store and issuing credits to myself for merchandise that was never returned and using them to buy products in the amount totally $21,000. At the time I was 18 or 19 years old. This was in 1996. I was convicted of breach of trust in 1997 and was sentenced to 10 or 15 years suspended to 5 years probation. I was offered pre-trial at the time, and the lady discouraged me stating that I could not pay all the money back in one year so I decided to for go that. If I was smart I would have taken it because I was still living at home and would have just given them all of my paychecks for a year. In any event, this was my first offense and the only thing on my background. I never missed a meeting with my probation officer during those 5 years, and I paid my restitution every month until I got into a financial bind. I paid a total of I believe $18,000 plus court cost during my five years. My probation officer never said anything about the remaining balance and closed my case because my 5 years was up. The company never came after me for the remaining balance, and it was never put on my credit. I have since never been in trouble again and want to know if I can get this conviction expunged or pardoned from my background. Please help if you can. Thanks nicole29611</div>
