I received a notice from my legal/advocacy firm and they said they'd been paid in full (been our pleasure to rep you, we're closing your case, etc).  Is it common for the legal representatives to be paid before the client receives retroactive benefits?</div>

			<content:encoded><![CDATA[<div>I live in Florida. I applied for SSDI Aug '06. It was an interview style application at the local office. I remember she asked me if I had any children. I said yes my son was just born in May 06. She asked for his social number but I hadn't gotten it yet from his mother. So I think she just put his name down on the application, I cannot remember.<br />

Now I got approved in Jan 09. But I hadn't applied for my son until August 09. When I got my sons backpay it was only 6 months worth, not from '06. I made an appointment and the worker asked me if I &quot;protected his record&quot;, by adding him to my disability claim. I said I didn't remember and so now they are getting the records from the application to check it out.<br />
<br />
Would he be protected by adding his name only, or did I need his social number? I'm still waiting for the file.</div>

I will try to be brief.  Filed for husbands SSDI.  Got denied the first time, refiled immediately.  My wife kept in contact with the SSA and made sure they had all the necessary documents.  We were pushed to hire an attorney.  We did the first week in June.  The attorney clearly stated to us that he would only get paid once we were approved.  After 3 weeks, wife called to see if he heard anything.  We were told no that he sent his paperwork in (we assume the paperwork was him telling them he was our attorney).  In mid-July, got a letter from attorney stating he was withdrawing from my case due to his overwhelming case load. Advised to get another attorney. Wife called another attorney and he said the first attorney would have to waive his fee.  Called first attorney, (he was unavailable).  Got a letter from him a couple of days later stating we owed him $153 for records and before he would waive his fee, we would have to pay it.  Wife called SSA and was told that until I got denied a second time, there was no need for another attorney she also sent the letter from the attorney stating he withdrew to SSA. She kept in contact with the adjudicator to make sure they had all my medical records and doctor letters.  Got approved for SSDi in August and they sent the attorney a check for 25% of my backpay.  Attorney now decides he is going to bill us per hour he spent on my case.  In the approval letter from SSA, it tells how much they are withholding to send to attorney and if we disagree to send a letter within 15 days.  We did the next day, send a certified letter to SSA informing them that all the attorney said we owed was $153.  It is in a processing center somewhere.  What can we do?  First of all, can we request everything from SSA that the attorney sent in?  Also, he has had the check since August and made no attempt to contact us or send us a bill.  My wife called his office 3 times before he called back and then when she said she would report him to the state bar, he threatened to sue her. :wallbang: Thank you for any help or advice you can give.  Sorry this is so long. I wanted to give you as much information as possible.</div>

My son attends a residential school in p.a. (since 2000) and it's board of<br />
ed funded. He has always had ny medicaid since 2000.<br />
He just turned 18 and now his medicaid was transferred<br />
without my knowledge to p.a. medicaid.<br />
I'm not sure if this is a good idea.<br />
<br />
One, isn't he still a ny resident because I'm his mom and live in ny?<br />
I'm not sure if I should leave things this way.<br />
<br />
Is this right?</div>

Two years ago, she was diagnosed with toxic metabolic encephalopathy. She has been bed-ridden since then. Family members mishandled her finances and she is in great debt and the bank has informed her of foreclosure. Family members in the area no longer want care for her. That leaves me to do it. I need to bring her to my home in another state and will need lots of help such as home health aides or adult day care. <br />
<br />
It sounds like SSI will follow, but I'm confused about the house being a resource since it will not be her primary home. She has basic activity (eat, bathe, dress, toilet using). She can not cook, clean, drive, manage finances or walk without assistance and often is confused. <br />
<br />
If I give the house back to the bank with a &quot;deed in lieu of foreclosure&quot;, is the house a resource in the look-back period? I would prefer to do this so the foreclosure will not hit her credit. Does this make sense? What do you think I should do with this house? Give it back or let it remain in foreclosure? I was told that I have to stop SSI claim in State A and re-apply in State B. My fear is that in re-applying, the house would make her ineligible. Then I have no way to care for her, financially or medically. :confused:</div>

My x-wife has a court date for ssi in san diego, ca. in jan. of next yr. that she has been waitng for about a yr. The lawyers office girl is telling us that we have to hand all the drs. and her shrink their forms (the lawyers) to fill out. So far two drs. refused to fill them out, and are saying that the lawyer needs only their dr. notes.<br />
<br />
The lawyers helper lady seems a bit incompetent in not being able to find documents and emails we send her until much later. Not concerned about a bad health problem she has (one of them). I talked to the lawyer about the problem, and he seemed a bit angry, and not nearly as frindly as when we sighned up. Didn't even look up her file while on the phone with me.<br />
<br />
My question is: Are we supposed to take the lawyers forms to all the drs., or is all of this business the lawyers job? Also, if we wanted to get another lawyer, would we have to start all over again with a new court date etc.? Thanks,<br />
