Police Conduct: Unfairly Investigated by Police Due to My Criminal Record

My question involves criminal law for the state of: New Jersey

Hi,

So I just wanted to write my story and get responses on the following :

A. What I can and should do to get justice in my mind, where I feel I was wrongly harassed, profiled.
B. Where should I go from this point onward to continue getting the justice I greatly deserve
C. What , if anything, could occur from this incident against me to the police force and improper use of their power as well as possible false claims leading them to do what they did.

Here is backstory about me that will pertain to certain aspects of this:

I live in not too large area. I can't really describe , but we have one main road and the rest are side roads to houses or to get to another main road. So all of the police know who each of the alleged drug dealers, users, rapists (if we have any), etc. They know all of them and they know their cars .. they especially know mine and have since I was 17.

So when I was 17 years old, I was naive to the law, my rights, and just over-all and idiot because I would smoke Cannabis in my car all day, everyday and then continue to drive around with 7g-28g at a time (when it was unnecessary). I got arrested at 17 , thank god, and came to a realization how I wash;t invincible. One of the officers who did arrest me, was there during this event I am querying about. I was arrested for alleged "Marijuana Possesion over 52g" and whatever else comes with that.

I ended up getting a lawyer and having it dropped to only under 52g, not a felony or anything, I admitted that I smoked during that time hours before this.. because they tricked me into it. BUT I was smart. I went the NEXT day to my doctor for a FULL drug screen, after taking a detox drink, all clean :). No dui/dwi, everything was cleared from my record and I was off of conditional discharge 2 months early for doing everything perfect.

TO THE POINT:

A about a week ago it was a Saturday, I had to pick up my Klonopin prescription and my Thyroid medication prescription because they were closing in 30 minutes. I was also looking for ANYTHING to do because I was pissed off at my mom for something she did, so I didn't want to go home. I arrived at a grocery store and I was in the car parked for about 5 minutes. I went inside, got my prescriptions and left. I then was sitting in my car at 8:45ish (I know because my friend got out of work at 9pm) and sat for 10 mins or more then left to go to the chinese place where he worked.

I drove perfectly normal and fine, and I was on the main road with maybe one car or two? behind me. I then bared right at a fork in the road to the BACK side of the strip mall the chinese place is in, went through the back and then came around the front and parked. I was parked in the front for AT LEAST 30 minutes, which can easily be identified by my phone calls/texts and my friend as a witness when he came out to talk. But, after waiting 30 mins.. he could't hang out. So... I left, but I didn't turn on the main road..... I went on the dark and small back road to the gas station.

I took that, it is literally 15 seconds away. The BACKROAD had NO cars on it. I came to a stop sign such as . __ | -- (In that, the period represents my car, the ____ repress the backroad, the | represent the road I would turn onto with a stoplight right at the top 100ft ahead and the -- represents the gas station. So it is a / direction to get in from my position.... BUT I did not just go straight across. I wanted to drive safe as I always do, I took a left, then right and not straight across.

Now I am at the gas station. I park in front of it and I am attempting to call a friend or two for 5 minutes while parked in front of the store. No answer, so I decide 'Might as well get gas while I'm here.' So I pull up to the pumps, I go inside and get a coffee and cigarettes... but I don't leave right away. I asked the person there, the owner... who has cameras in and outside the store to prove everything. I asked if he was looking to hire anyone, as I need a job and my best friend I've had for my life was their best employee . I bullshitted for a while and give him info about me, and wrote it down. I was at the gastation and pump for 15-20 minutes and then I got in my car... tried to call someone else... no answer.

I then pulled out of the pump and went to leave, but I was on the far side where it was shadowy and not near the road or gas station.. the far ahead where there are odd parking spots. I was going to sit there quick and leave to go home..... and this part, now that I think of it.... really , really seems fishy. I think they were waiting for me when they saw me not parked in a parking spot, but stopped and about to leave to go home... then they did see me park and were GOING to pull me over when I left, but once I parked they decided they had to come up to me instead. Giving them pretty much nothing at all to work with against me as I wasn't pulled over for a traffic violation.

I'm parked there for 3 minutes. I look at my side view mirror and what do I see? TWO cops ... walking to the car. My window is open because I have a cigarette, I have a hat on too, and ( I am actually very proud of how much I shut those dicks down. I completely owned them at EVERY opportunity with my extensive knowledge of MY rights and the LAW and what I CAN do and what they CAN and CANT do. They said to me they were surprised, they told it to my dad and 'He is asking very good questions') then who is the cop there? The one who arrested me at 17yo, I am 21 now.

He asks me " Hey -------, would you mind stepping out of the car?"
AS THE ONE IS SAYING THIS SIMPLE POSSIBLE TRAFFIC VIOLATIONS TO ME, HIS PARTNER IS GOING AROUND MY CAR IMMEDIATELY WITH A FLASHLIGHT FROM THE OUTSIDE LOOKING AROUND .... I know this what not about something that didn't happen... they wanted to just TRY to nail me and scare me into a search and hope/thinking I still smoked and had Cannabis.

D (2 min<) C (10 seconds<) B (2 1/2 Min) A ---- Just to sort've have an idea of the distance between.

"Uhhh... yeah (as in no I'm not getting out). What's this about, I've been parked here. I didn't do anything wrong."
"We got an call from ---neighboring p.d--- about an anonymous call of you driving erratically."
"Oh.. well what did they say? Where, how ?"
"I don't know, it was anonymous and we got that call and then now we are here. So could you just step out of the car please?"
"Well, am I under arrested or something?"
"No hahaha (in a dick way), why is there something you did or have that you should?"
(I asked because I wanted to know.. not because I did anything.. and they just condescended me like that..)
"No at all, I just want to know. Am I under arrest?"
"Well unless you did something we should know about, no."
"Then if I am NOT under arrest , you don't have the right to detain me and I am free to go, right?" ... every time I brought this up they said yes quick but brought something else up.

Then they just asked for my credentials , I gave them to the one guy. The other stayed, asked me the normal questions . Where are you coming from. Where are you going? Have you taken anything today? Prescriptions ?

I told him the truth. I took my Adderall that I've been prescribed for over 6 months, Klonopin that I just picked up (I showed him because I just got it) that I have been on for 3 years. And that was it.

He says the reason he asks is because my pupils are not responding to light -_-.... and says generally when someone's pupils don't respond to light it is because they smoked weed or did drugs. But he did understand my adderall does that too, but seriously now.. if I was HIGH , which I wasn't , my eyes would not be O _ O , they would be - _ o . You know, closed .

Secretly while they were both gone I call my house, 2 mins away, my mom picks up and I say "is dad home? is dad home?! get him, get him get him... Dad.. I am at lukoil, i did NOTHING.. and i don't know what to do or whats going on.. Idk if u want to come here and try to help but, idk ." he said he didn't know either, but eventually came because he is very nice and very persuasive and I tell him everything about me and my drug usage in the past and he probably said I stopped a long time ago.

Sooooo... I am not out of the car yet, but it was very strange. Normally when I get pulled over , which is never, I am nervous/anxious/shakey because everyone is. I take my hat off and cigarette off and be very respectful, but when they came up the first time and while I was in the car.. i have not one shred of anxiety, not one shit given for them and I basically had a smirk and thought to my myself " ::roll eyes: This is sooooo ****ing bullshit. Every aspect of it. Nothing they are doing makes sense, nothing they have is probable cause to do anything. I am PARKED. I did nothing , I know my rights, I know the law very well after I got arrested. This is ****ing ridiculous and I am going to just completely school them at every chance I get. Because A. I have nothing on me, or in my car because I don't do drugs anymore. and I didn't do anything wrong)

I get asked to step out of the car, I ask Why??. They said, just to talk.... I said we are taking now, but whatever fine. Lets get it over with.

I get out of the car and they ask me stuff like what prescriptions I am on and what I took today. I said my Adderall like I do every day, my klonopin, and those are all. Then they do that complete bullshit rigamarole of trying to get YOU to be naive and ADMIT to driving under influence of anything, admit to anything and by your own free will cause yourself to be guilty.

"Have you drank at all today? Have you smoked at all today, be honest with me, when was the last time you did smoke? Be honest with me here, I am trying to help you " :glee: LOL

Even if I did drink at all, or smoked or did anything. I wouldn't willing confess. But I didn't. He asked me even when i did Heroin last.... and I didn't want to talk about that part of my past, I felt it was very rude and disrespectful for him to ask me if I had NEEDLES in my car. HOW LONG I was doing DOPE for. And said "Oh you were just sniffing it?" Like **** him ... I didn't answer those questions because I felt absolutely no relevance for answering... it was rude and disrespectful and condescending.

Then the one office dose a "Sobriety Test" on me.. if you can call it that. I say that because when I was arrested, they did at least 5 tests on me. He did 2... one where I stand one leg, lift one foot pointed and count by a thousands (very easy when I know rhythm from guitar.) and then do that walking straight test with one front in front of the other 9 times. I did "o.k." ..... now that I think about it, their lights were NOT on , so none of this was video taped.

I finish and the other officer is talking to my dad . I wait, he comes over and what does he do? He has a CONSENT to search form! Lmfao.
He starts going like "Alright you just need sign here and here and this is basically saying we can search your car ....." I interject immediately, because he just assumed I would be naive and stupid to just be like SURE!!!! I go woah woah woah, wait what? Consent to search? For what? I did nothing wrong....
I asked him "Wait, so am I under arrest?" "...no" "So then I am free to leave .." "well yeah.." "So then if I am not under arrest, and there is not investigation here.. i can leave, right?"

and then he says some bullshit intimidation thing that my dad was scared of, saying WELL YOUR PUPILS ARENT RESPONDING TO LIGHT AND IT SAYS ON UR ADDERALL AND KLONOPIN BOTTLE.. DO NOT OPERATE HEAVY MACHINERY. IF YOU DONT CONSENT, WHICH YOU CAN OR CANT, WE COULD CALL THE JUDGE AND GET A WARRANT POSSIBLY AND CONTINUE THE INVESTIGATION. AND WE COULD IMPOUND THE CAR.

They had absolutely nothing on me. Nothing. I knew it, they knew it because anything they tried to use against me, thinking I was an idiot like I used t be, I shoved it in their faces. I knew I had nothing in my car, I knew 100% I had nothing in there.. i just didn't want to give them the satisfaction to search my car. I didn't want to give them that power. I wasn't going to because I knew nothing would happen. They couldn't do anything. They didn't even pull me over, i was parked. There were no lights on on their car. I had nothing to lead them to believe anything other than my pupil from my adderall I have been on for 6 months and that is says don't drive while on it.... even though that doesn't matter. If I wasn't fit to drive, my doctor would not let me. And adderall makes you more focused!

But, my dad was just like... just do it so we can go please. So I let them do it.

BUT..... during this I asked a VERY important question that is going to help immensely . I asked "I'm just curious... This "erratic" driving call you got. WHEN did it get called in and WHEN after that did you see me?"

"Well it was called into the other P.D (btw I wasn't anywhere near that town), and then 3 minutes after we saw you."

so I said "....That makes absolutely no sense... at all. I was parked here at the gastation for at least 10-15mins and inside talking to the owner. Before that I took the backroad to get here, no car saw me, and I was PARKED at the chinese place for 30+ minutes. Before that I was at the store for 20+ minutes. I drove less than 4 minutes.

He then said.. well I don't know. You can call and ask tomorrow.... which I said. Yeah I will.

So, I didn't call because I don't want to possibly mess anything up for me. I am going to write on here, see what responses I get. Then I am going to call my lawyer Monday, ask him what he thinks and for him to call the police to get all the details on what happened to me, what this "erratic driving" call was, and all of that.

Why? Because I feel it is 100% harassment and profiling against me and it is bullshit. I have a car they know is me. They knew I used to 'allegedly' sell Cannabis. They have ever since I was 17 trying to catch me slip up. I stopped smoking a while ago, I don't ever have anything in my car either way, but I could tell.. with everything I realized and just how it happened, the story of erratic driving, how they were looking in my car immediately from the beginning for a "traffic" type stop they didn't even see or have any witness to. They did not mention anything about that call besides using that to come up to me in the first place. They quickly found the best reason they could to find a way to try and convince and intimidate me into a search consent. That is all they were trying to do the entire time. Getting me to either admit to something, which there wasn't anything. And they go to the consent to search as fast as they could. They weren't at all interested in this "erratic driving" they were only interested in looking in my car, thinking they could use this against me, thinking I would have something in my car, thinking I would be high , thinking something would be here and I would have slipped and they have something against me.... all of it makes sense ...and I want ****ing justice for this bullshit.

My question involves civil rights in the State of: California

I need help finding a penal code or tort violation for an illegal civil battery that sends EMF signal to batter individuals physically or sexually, supposedly for purposes of law enforcement. It is an Electro-magnetic frequency signal to the penial gland to the brain that may cause auditory or visual hallucination. When I had last looked up the case I found that the judges comments on it were Blue by Day White by Knight. The crime was punishable up to a $1,000.00 fine or up to a year in jail, ten years with physical harm from the battery and up to life imprisonment with sexual abuse. Common signals to the supposed law enforcement battery electro-magnetic frequency are chuck, kluck, tinkerbell, pencil, eraser, choclate love, heart, chicken , high nickle and dog ears and nose. The most common frequency signal that should be well known is tinkerbell. I need a penal code or tort number. I lost the number last I looked it up and have been unable to recover it in the books and Lexis Nexis, any help is most appreciated.

My question involves police conduct in the State of: Tenn

My car was junked by my roommate in January while i was away for a few days and my mom was at work at the time. I told the detectives it was my roommate but they said with no witnesses or paper trail they could do little. That was reasonable. A but after this I come to find out another neighbor I rarely talk to seen the whole transaction between him and the wrecker/scrapper. He said he didn't want to get involved with the police though. My question is this, I know my states audio taping laws, its a one party consent state, if I have him on recording admitting he seen the whole thing go down can i send the police to his house based on that to interview him? I know he'd probably tell them he doesn't know but is it a crime to deny that when I can prove to the police he did see the transaction? Could that be used as leverage against him to cooperate with the investigation? Could he still refuse to testify in a court? This is basically a last ditch effort so there are no alternatives at this point..
