Fraud: Is it Welfare Fraud to Get Benefits Without Reporting Child Support

My question involves criminal law for the state of: CA

About a month ago my brother received a call from child support services stating at case had been opened against him. He has been paying his ex wife directly per their agreement.

Apparently, his ex wife had signed up for welfare but failed to report that she received child support (well over $1000/mo). At first, child support services was trying to hold him responsible for almost $30k in back child support he had already paid. He then provided DCSS with a notarized receipt from his ex-wife that said he was current through May. DCSS accepted the notarized letter and adjusted to him being current. But now, DCSS says he owes nearly $3000 in money back to Welfare, even though they acknowledge he is paid up on child support. Note to self and others, if you ever pay CS to another party, only get NOTARIZED receipts... Apparently DCSS in California does not accept other kinds of receipts without going to court and letting a judge decide if the receipts are valid.

My question is, did his ex wife commit fraud? If so, how likely is it that there will be any kind of investigation or consequences for his ex wife?

My question involves criminal law for the state of: California

Hey all,

In the past I would resort to shoplifting small items (sodas, etc) from Safeway and other convenience stores and would always try to change my ways. But I've got a question.

A few days ago, I shoplifted from my neighborhood Safeway, as I had done several times in the past without getting caught. I was always very mindful of the cameras and (to my knowledge) have never been spotted on them (I figured they would've apprehended me by now). However, when I came into Safeway tonight prepared to do the same, I noticed I was being watched by an employee. Terrified, I decided to change my mind. I made my way to the self checkout, paid for my items and went out the door. I did not shoplift that night. After that, I can't even begin to imagine me shoplifting again. However, I noticed that same employee standing next to my car looking at it with his phone out, possibly taking down a license plate.

Sidenote: I also thought I left my phone inside, so I had to ask him whether he'd seen it. He brought me to the back to run the CCTV footage and didn't turn up anything. As I left he said "stay outta trouble, man." I laughed and left.

My questions are as follows:
1. If he did in fact jot down my plates, could he still file a report with the police? I was never asked for identification or any personal info, nor did I commit any crime on this particular night (the camera footage backs that up).
2. If he did decide to push forward, would it be worth their time to dig through hundreds of hours of video footage to catch my stealing a $2 soda?
3. If he did push forward, how would I find out? A knock on the door by the police?
4. For thefts as small as mine, how likely is it that they'd follow through? I've only committed a handful from these stores over the past 2 years, and I've never been watched leaving the store or anything.

Either way, they still scared the daylight outta me, so I'm sure I'll never do it again. I have absolutely no criminal record and want to keep it that way. So I guess they did their job. I'm just curious if they'd follow through on anything that happened that night. Thanks guys.

My question involves criminal law for the state of: Oregon

My friend and I got an MIP. However, nowhere on my citation does it say MIP?

The ticket only says BAC 0.0367 and 2013CO2379. Also, on the back of the citation, option 1 says "enter a plea of no contest and pay the court the amount of the presumptive fine". I looked at the presumptive fine written on the front of the ticket and there is nothing written in those boxes. Does this mean that I am off the hook? And if so, if I "pay" the fine of nothing, will it still be on my record?

Update: The officer called me today and said he forgot to write a fine on the ticket and a MIP citation so he said he had to legally tell me that he was changing it. He didn't tell me what the fine was. Should I fight it? He wrote the ticket messily, wrote the wrong DOB and spelled my name with an O instead of an A. If I fight it and win, will it still be on my record? Is this enough evidence to fight it?

My wife and I were talking to a woman online as friends and this woman became attracted to her and started harassing her and I. We have gotten a restraining order against her. It she violates it. Week not know this woman's real name, have her address or other identifiable information. She follows us, texts from an app-based phone number, makes death threats and has committed battery against my wife. Yeateday she tampered with my truck with the intention of causing my wife and kids to into a fatal accident. I know it was her because it was confirmed that my truck was intentionally tampered with and no one else would do such a thing. We have no proof other then a text she sent asking if I liked her 'surprise' and that I 'killed her love (among me for her actions). Sorry this iong. This woman is dangerous and police said they will not trace the phone number and that they cannot take a report for the amateur to my truck (which resulted in my wife and kids getting stranded on the fwy) becaue we have. I evidence that it was her. This woman is causing my family a great deal of fear and stress and we need this to stop. Any help on the matter would be immensely appreciated. Thank you.

My question involves criminal law for the state of: California

I have also posted this in a forum where I was only able to get the take of one person on it, so I am also posting here as I am worried)

My husband was trying to be nice to a coworker who had been suffering with a headache and gave him one of his prescription Tramadol. I have done some research and the drug is not on the Federal or State listings of Controlled Substances. As such, it is my understanding that he did nothing criminal by giving the person the medication. And that possession of the drug even without a prescription is not illegal in CA. (Don't get me started on whether or not it was stupid). The person ended up going to the doctor the next day where he did tell the doctor about the Tramadol...but the doctor saw no ill effects from the drug. In fact, the person was told to cut back on sodium.

As it is not a controlled substance, I just wanted to verify that there will be no legal repercussions for him giving the coworker the pill.

Also, if there are any repercussions (or even possible ones) here is the rest of the pertinent info:
1. My husband has a current and legal prescription for the drug
2. My husband has a completely clean criminal record
3. The total amount given to the coworker was 1 (one) 50mg pill
4. Mu husband did not ask for or receive any money for the pill.

Can someone please put my mind at ease on the likelihood of him getting in trouble for this? (Other than by me?)

My question involves criminal law for the state of: Mississippi

Undercover cops came to my house while I was in class in March, my roommate answered the door figuring it was the landlord. The cops saw paraphernalia inside and came inside, once inside they were looking for me but I was in class so they called my cell phone and said if I didnt come right away home that they were going to arrest my roommates and wait for me to get home and arrest me too. So I come home and they are standing in my living room waiting for me to unlock the door to my room, they tell me that I have to sign a consent of search (which was stupid of me) but I signed it trying to be as corporative as possible. Once they search my room they find about 48 grams and a scale in my safe. They take me in handcuffs and put me into their truck, two of them go in a car and one detective takes me in his truck to a park we sit and chat for a several minutes, he says that if I tell him the name of the person I got my marijuana from he will let me go, but I have to meet with him the following day and he wont take me to jail. Being scared I tell him and show him where my guy lives that sold to me. He gets more cops and they basically do the same thing to him that they did to me. He let me go back home that night but said we would be in contact. The next day he called me and told me to meet him in his office, I met him and he told me that I was either going to jail or becoming a "certified informant" I chose to be an informant bc I had no way to get out of jail at the time. Well a couple weeks went by and nothing had happened, but now he is calling me saying that I have to get 8 people in trouble or he will indict me to a grand jury and eventually jail. I want to know what exactly can happen if I dont get the 8 people in trouble he wants by the end of July, since I was never arrested, what can happen? I feel like they are just threatening me.

This is in Starkville MS.

Not only, do I not want to have to get others in trouble, I don't think could even come up with 8 people in a 3 month span.

But I am basically looking for some advice on what to do from my current situation.

Sorry if this is the wrong part of the forum, I didnt see any where better.
Thanks a lot for the advice.

I have been told that I can still be arrested, but how would that work? He didnt arrest me at the time, I hadn't been a confidential informant yet, and he just let me go within an hour of finding 38 grams in my house. It just doesn't make sense.

My question involves criminal law for the state of: Georgia, USA

Hello Everyone.
Basic Details:
I'm 17 years old.
I recently visited a County jail in Georgia for Possession of Marijuana and Driving on a Suspended License.
I spent about 8-9 Days in Jail (including the booking period).

I have a Court Date on June 4th.

Story:
I got pulled over by a County Officer as a random search for guns in the vehicle (someone was apparently riding around shining for deer and shots were fired) and when he pulled me over he saw that I had some marijuana leaves and stems on my leg, he asked me to step out the vehicle and he proceeded to put me in handcuffs. He then proceeded to search the car, but I didn't have anything on me. He asked if I had my license and I said I didn't have it on me, so he searched me and it so happened that my License was suspended. :wallbang:
The reason behind my license being suspended was that I was withdrawn from school, but I had no idea that my license was suspended.

Since then I have been doing homeschool for the 2 credits I need to be a senior next year, and I have been doing community service hours.

Question:
What would be the worst case scenario as to my charges in court?

Any questions feel free to ask, not sure what information to put on here.

My question involves criminal law for the state of: Minnesota
On April 28th I was at a party that got busted and I blew 0.000 but the officers said that i was still probably going to get a minor because I admitted to drinking. That following week they called everyone that was that party and that we were getting minor in consumption charges and that we would be getting them in the mail. My family was not home when they called so we never got to talk to the cops and they have not called back also there was a total of 7 people that were informed that they were getting minors. Four of them were 18 years of age and the other 3 were under 18 years of age. I am one of the minors under the age of 18. The four that are 18 years of age have already gotten there minor in consumption charges but us the ones under 18 have not so my question is will we be getting them because its been nearly 2 weeks since they called.

My question involves criminal law for the state of: MISSOURI

Hello-hoping someone might be able to help. My 22yr old son is being accused of credit card fraud. He had been living with his dads ex-wife, her bf, and another friend of those two. My son had a motorcycle that he wanted to get work done on and one of the guys offered to help him pick out the parts. He told my son he would take care of it and for him to just pay him back as he could. So on a couple of occasions the guy got on the internet and would confirm with my son the parts he wanted then this guy would make the purchase. My son had paid him back in cash.

When the items came in, my son took the parts and his bike to a shop to have everything installed. When it was ready, my son wasn't able to afford all of it. He asked the bf if he could take care of it, he couldn't so the other guy asks how much it is then says he'll take care of it for him and for my son to pay him back. The guy made the charge with the shop over the phone. My son went to pick it up and was told there was still a balance of $15 so he paid it.

Yesterday, my son was contacted by the police asking him to come in for questioning. He left work early so he could. He was questioned regarding the payments and for a $300 transfer to his bank account that he never realized had happened. My son proceeded to tell the police his side of the agreement he had made with the other guy.He signed his statement and acknowledged his miranda rights He didn't request an attorney cause he knows he didn't do anything wrong.( I know, I know) The other 3 were also questioned. The officer told her that all of their stories matched up, and everything is on my son. They never said he was arrested, but they did take his pic and fingerprint him. They didn't search him or take any of his belonging. Just said they had to put him in the system cause they didn't have any updated pics and such since his license. They released him immediately after with a summons for court on the 24th which my son believes is to tell his side of the story.

My son has NEVER EVER been in trouble for anything!! He has worked consistently since he was 16, sometimes 2 jobs! He is in school for Criminal Justice because he is going to (hopefully still be able to) become a police officer. Still tinkers with the idea of joining the Marines-still has his recruiter he talks to. He has also worked with the County Explorer Program for 3yrs. He's a good kid!!! Now on the other hand, these 3 misfits, she was charged, along with his dad, for felonies involving obtaining a script pad illegaly(was stolen from her work-they caught the dad using it) and for stealing Oxys, plus some other things. Shes on probation still I think. One of the guys is a sex offender andI forgot what the other ones deal is. But the 3 of them are very, very, close-if ya get my drift.

What do you think is going to happen to my son? I know it doesn't look good cause everything is in his name. Its 3 against 1, how does he stand a chance? Can this get taken care of without it becoming a felony? BTW the guy whose card it is, is the girls ex who is ALSO in jail right now. She has his CC# written down hangin on the fridge. Anyway, would it be ok if I call the mother of the guy offering to pay it back before the 24th or could I get into trouble?I'm not wanting to do it cause my son is guilty-I'm just afraid that he will have to take the fall for 3 shady A-holes and I don't want his life ruined. Any advice would be greatly appreciated!! Sorry so long. Thanks!

My question involves criminal law for the state of: va

Today I was caught shoplifting at lord and taylor. I cooperated with the loss prevention officer and was totally honest because I know I have a problem and i am getting help. I told him of 3 past incidnces I remember where I shoplifted from that store. I paid for items I damaged and estimated cost for what I took in the past. I also paid a cival penalty. He was nice and did not call the cops.

I want to move on, get help, and put this behind me, but I am worried that I might be forgetting previos items I took. Is it possible for me to be criminally charged in the future for what I took today? Is it possible for them to review security tapes and find previos instances of theft and charge me? What should I do?

If a female age 24, has sex with a minor and he is only 17 at the time, can she be charged 4years later.

My brother was sexually involved with a female, he later found out she was married and her real age. She ended up pregnant but after the baby was born realized it was my brothers (she and her husband are African American & my brother is mixed, white & black).

She gave the baby her husbands last name although the baby looks just like my brother. He has tried putting himself on child support by going to the child support office, he is not even allowed to see the baby.

I wanted to report her once I found out her age. He just turned 21, she is 29 and their baby just turned 3. He just had turned 17 when they engaged in sexual acts. What the time frame, limit to report statutory rape and how can he gain parental rights?

He wants to be a father and she only wants to say the baby is his when she needs money (lumps sums, every 3 months) that's the only time he is allowed to see the baby. What are his options?

:grumpy: My question involves criminal law for the state of: N.Y HI, I WAS LIED TO ABOUT MY DAUGHTER'S FATHERS DOB AND NAME. HIS MOM WAS AWARE OF OUR RELATIONSHIP AND NEVER TOLD ME ANYTHING, SHE ACTUALLY CALLED HIM BY THE OTHER NAME AND EVERYONE WHO KNEW HIM WHERE WE LIVED AT. NOW AFTER 13YRS I FOUND THEM AND IT COMES OUT HE WAS USING HIS BROTHER'S NAME AND DOB AND WHEN I CONFRONTED THE MOM SHE SAID I RAPED HER SON AND THAT SHE WAS GOING TO GET ME IN TROUBLE. I HAVE PROOF SHE KNEW ABOUT HIS AGE AND DID NOT TELL ME AND ALSO POLICE RECORDS SHOW HIM AND HIS BROTHER USING THEIR NAMES TO AVOID GETTING CAUGHT. SHE ALSO HAD SPOKEN TO MY DAUGHTER AND TOLD HER THAT THE DAD'S NAME WAS THE ONE I ALWAYS BELIEVED TO BE. CAN I GO TO JAIL FOR THIS MESS?

My question involves criminal law for the state of: New Hampshire

I live in MA but this happened in NH. So I was caught shoplifting at Walmart with a total of $40 and this was my first time ever getting in trouble for anything . They took me in the back and made me sign papers claiming they wouldnt call the cops but they still did. I was arrested and brought to the station where they took pictures and fingerprints. I was paranoid and didnt know what was going on when I signed a paper that said I was guilty and they gave me my court date and I was bailed out for $40.

So what Im asking is what should I plead Guilty or not guilty even though I signed papers saying I was guilty?
What kind of fine should I expect and will I get jail time?
Is there anyway I can keep this from being seen by Jobs and Colleges?

Please I need help and already read almost every article on here but seem to get mixed stories.
